PHOTOGRAPHY SERVICE AGREEMENT & TERMS

1. SERVICES & ATTENDANCE

The Photographer agrees to provide photography services as described in the specific booking or invoice associated with this agreement. The Photographer is the exclusive provider of professional photography for the duration of the event/session.

2. RETAINER & PAYMENT

  • Booking Retainer: A non-refundable retainer is required to secure the date. This amount will be applied toward the total balance.

  • Final Payment: The remaining balance is due in full prior to or on the day of the session.

  • Work Stoppage: The Photographer will not deliver any images or products until the full balance is paid.

3. CANCELLATION & RESCHEDULING

  • Client Cancellation: If the Client cancels for any reason, the retainer is forfeited as liquidated damages to the Photographer.

  • Rescheduling: Requests to reschedule must be made at least [48 hours/7 days] in advance. A rescheduling fee may apply.

  • Photographer Failure: If the Photographer cannot perform due to illness or emergency, they will attempt to find a qualified replacement. If a replacement cannot be found, all fees (including the retainer) will be refunded, and the Photographer shall have no further liability.

4. ARTISTIC STYLE & EDITING

  • Artistic Discretion: The Client has spent time reviewing the Photographer’s portfolio and grants the Photographer full artistic license for the shoot and post-processing.

  • Raw Files: The Photographer does not deliver raw, unedited, or "straight out of camera" files. Only the final, edited images selected by the Photographer will be delivered.

  • Re-Editing: Any requests for additional retouching beyond the Photographer’s standard style may incur additional fees.

5. USAGE RIGHTS & INTELLECTUAL PROPERTY

  • Ownership: The Photographer retains the copyright to all images created.

  • Personal Grant: The Client is granted a non-exclusive license to use the images for personal use, including printing and sharing on social media.

  • Prohibitions: The Client may not sell the images, enter them into contests, or apply third-party "filters" that alter the Photographer’s original edit.

  • Model Release: The Client grants the Photographer permission to use the images for portfolio, social media, and marketing purposes unless otherwise agreed in writing.

6. LIMITATION OF LIABILITY

  • Safety: The Photographer is not responsible for injuries sustained during the session.

  • Loss of Data: In the unlikely event of equipment failure, theft, or digital data loss, the Photographer’s liability is limited to a full refund of all monies paid.

  • Coverage: The Photographer is not responsible for compromised photos due to weather, venue restrictions, or uncooperative subjects.
